중국의 지식재산권 질권 담보제도에 관한 연구

Abstract

As the development of intellectual property pledge of China, the intellectual property pledge plays an important role in the propertification, commercialization and industrialization of scientific achievements. It also enhances the competitive of Chinese technology companies. It is shown that the intellectual property pledge of China has a significant profound to the progress of Chinese enterprises.

Especially on the aspect of solving the problems of the shortage of funds for small and medium enterprises, the intellectual property pledge is an important pathway. As the blooming of economics and technology, China steadily gets to know the importance of intellectual property pledge.

People’s Bank of China and Chinese State Intellectual Property Bureau start to push the development of intellectual property pledge by many ways. Chinese government also begins opening work pilot for it. Due to the early states of intellectual property pledge of China and the complicated factors that are needed to design it, intellectual property pledge of China is now on immature state.

So far, Chinese government has fundamentally set up the intellectual property pledge related law and the enterprises have the relative stable law to obey. That is to say, the market of intellectual property pledge of China has been steadily set up and improved. At the present stage, because of the difficulty to precisely evaluate the intellectual property, Chinese financial institutions need to take big risks for loan. This is a severe problem for intellectual property pledge of China at the present stage.

Setting up the blameless intellectual property pledge system and method and developing mature trade market for intellectual property pledge for China is a simple but lengthy process. Intellectual property pledge is an indispensable way for small and medium size of science and technology enterprises. Chinese government gets to know the issues about intellectual property pledge and they are consummating intellectual property pledge management system and intermediary service system. This gives the financial institute some channels for risk diversification.

This paper systematically introduces the history and present state of intellectual property pledge of China. It also gives the organization and institution of intellectual property pledge to let foreign scholars to know better about it. This paper will separate five parts to discuss about it.

The first part is introduction, mainly to point out the important role that intellectual property pledge plays in the development of economics of China and the research content of the paper. The second part is to summarize the concepts and category of intellectual property pledge in order to have roughly understanding of it. The third part begins with the developing history of intellectual property pledge. By explaining the referred department of intellectual property pledge to introduce the process, program and evaluate method to further understand the present state of intellectual property pledge. The fourth part is to conclude the opinions from different scholars. It supposes some issues that intellectual property pledge faces and some suggestion that is given by the author. The fifth part is the summarization of the whole structure of this paper.
