지능형 해상교통정보서비스의 제공 및 이용 활성화에 관한 법제적 연구

dc.description.abstract In 2006, International Maritime Organization decided to introduce e-Navigation, which integrates and combines the latest Information and Communication Technology(ICT) with existing ship navigation technology in order to reduce marine accidents caused by the negligence of ship operators and to improve shipping efficiency. The detailed tasks are carried out according to the ‘Strategic Implementation Plan’ established in 2014, and e-Navigation will be implemented in stages from 2020. Other International organizations and associations such as the International Hydrographic Organization(IHO) and International Association of Marine Aids to Navigation and Lighthouse Authorities(IALA) are also developing standards for data, services and communications for the introduction of e-Navigation. Several countries, including Denmark, Sweden, and the United States, are actively pursuing e-Navigation, such as promoting related projects. In order to preemptively respond to the movement of e-Navigation by the international community and to reduce domestic marine accidents caused by human factors, the government-led “IMO Next Generation Maritime Safety Management System Technology Development Project(Korean e-Navigation Project)”is underway since 2016, and plans to provide public service from 2021 when the project is completed. The Korean e-Navigation project, which is referred to SMART-Navigation Project, is based on the concept of e-Navigation by the International Maritime Organization for vessels engaged on international voyages, considering the characteristics of Korea’s maritime traffic environment such as fishing vessels and small ships. 6 services, which support safe navigation of vessels, are being developed, and at the same time, the e-Navigation operation system and LTE-Maritime, the infrastructure for providing these services are being built together. For the successful construction of the next-generation maritime safety management system, it requires the provision of laws to support it as well as smooth implementation of the SMART-Navigation Project. As a result, legislation of the 「Draft Law of the Provision and Utilization Promotion of Intelligent Maritime Traffic Information Service」 is being enacted as a government legislation. The bill is expected to be came into force from 2021, when SMART-Navigation Project ended, and the government is expected to establish the next generation maritime safety management system and provide public services. This study identifies the areas that need improvement and suggests ways to improve them through the legislative review of the 「Draft Law of the Provision and Utilization Promotion of Intelligent Maritime Traffic Information Service」, which is currently under legislation. First of all, the scope of application of the bill were examined and as a result, foreign-flagged vessels and the technical communication coverage of LTE-Maritime, which is a communication network for providing services, should be considered. In addition, in terms of harmonization with other laws, the installation of receivers required by the bill is not reflected in the ship’s facility standards. Therefore, the relevant facility standards need to be revised, and related technical standards and performance requirements should be prepared. Lastly, in terms of service provision, the government’s obligations and efforts as a service provider for smooth service provision are specified, while the requirements for on-board users as service users seems to be missed. For example, it is essential to secure real-time location of ships for accident vulnerable vessel monitoring support service, but the provisions for this are not mentioned. As such, the essential requirements for the smooth provision of services and the guarantee of quality need to be defined even through revision of the bill or subordinate legislation. Through this research, the next generation maritime safety management system based on SMART-Navigation Project will be successfully established based on a solid legal system to protect the lives and property of the people and further contribute to the introduction of international e-Navigation.|국제해사기구는 2006년 선박운항자의 과실에 의한 해양사고를 저감하고 해운 효율의 증진을 위해 기존의 선박운항기술에 최신 정보통신기술(ICT)을 융·복합하는 e-Navigation을 도입하기로 결정하고 2014년에 수립한 전략이행계획에 따라 세부과제를 수행하고 있으며, 2020년부터 단계적으로 시행할 예정이다. 국제수로기구(IHO), 국제항로표지협회(IALA) 등 국제기구나 단체에서도 e-Navigation의 도입을 위한 데이터, 서비스, 통신 등의 표준 개발을 진행하고 있으며, 덴마크, 스웨덴, 미국 등 여러 국가에서도 저마다의 e-Navigation 전략을 수립하고 관련 프로젝트를 추진하는 등 e-Navigation 도입에 적극적으로 나서고 있다. 우리나라 또한 이러한 국제사회의 e-Navigation 도입 움직임에 선제적으로 대응하고 인적요인에 의한 국내 해양사고를 저감하고자 정부 주도의 「IMO 차세대 해양안전종합관리체계 기술개발 사업(한국형 e-Navigation 사업)」을 2016년부터 추진하고 있으며, 사업이 종료된 2021년부터 대국민 서비스를 제공할 계획이다. 한국형 e-Navigation 사업은 국제항해선박을 대상으로 하는 국제해사기구의 e-Navigation 개념에 어선, 소형선 등 우리나라 해상교통환경의 특성을 고려하여 사고취약선박 모니터링 지원서비스 등 선박의 안전항해를 지원하는 다양한 서비스를 개발하고 있으며, 동시에 서비스 제공을 위한 인프라인 e-Navigation 운영시스템과 초고속 해상무선통신망(LTE-Maritime)을 함께 구축한다. 한편 차세대 해양안전종합관리체계의 성공적인 구축과 정착을 위해서는 한국형 e-Navigation 사업의 원활한 추진과 더불어 이를 뒷받침하는 법률의 마련이 필수적으로 요구된다. 이에 따라 「지능형 해상교통정보서비스의 제공 및 이용 활성화에 관한 법률안」의 입법이 정부입법으로 진행 중이며, 동법 시행령·시행규칙이 마련되고 있다. 이 법률안은 한국형 e-Navigation 사업이 종료되는 2021년부터 발효되어 정부에서는 이를 근거로 차세대 해양안전종합관리체계를 구축하고 대국민 서비스를 제공하게 될 것으로 예상된다. 이 연구는 현재 입법 절차를 밟고 있는 「지능형 해상교통정보서비스의 제공 및 이용 활성화에 관한 법률안」의 법제적 검토를 통하여 개선이 필요한 부분을 식별하고, 개선방안을 제시하였다. 먼저 적용범위 측면에서는 법률안의 적용대상과 지리적 적용범위를 살펴보았으며, 그 결과 대상선박의 국적·종류·운항특성 등에 따른 체계적 고려와 함께 서비스 제공을 위한 통신망인 초고속 해상무선통신망(LTE-Maritime)의 기술적 통신 커버리지를 고려해야 할 것으로 식별되었다. 또한 타 법률과의 조화 측면에서는 법률안에서 요구하는 수신기의 설치가 대상선박의 설비기준에 반영되지 않고 있어 해당 설비기준의 개정이 필요하며, 이와 함께 관련 기술기준 및 성능요건이 마련되어야 할 것이다. 마지막으로 서비스 제공 측면에서는 원활한 서비스 제공을 위해 필요한 서비스 제공자인 정부의 의무와 노력은 명시되어 있는 데 반해 서비스 이용자인 선상 사용자에게 요구되는 사항은 일부 누락되어 있다. 예를 들어 사고취약선박 모니터링 지원서비스를 위해서는 선박의 실시간 위치 확보가 필수적이라 할 수 있으나 이에 대한 규정은 언급되어 있지 않다. 이와 같이 서비스의 원활한 제공 및 품질 확보를 위해 필수적으로 요구되는 사항에 대하여는 법률안의 개정 또는 하위입법을 통하여서라도 규정되는 것이 필요하다. 이 연구를 통하여 한국형 e-Navigation 사업을 바탕으로 차세대 해양안전종합관리체계가 견실한 법체계를 기반으로 성공적으로 구축되어 국민의 생명과 재산을 보호하고, 나아가 국제 e-Navigation 도입에 기여하고자 한다. -
