Abstract
우리나라는 지리적인 영향에 따라 과거부터 식량에서 어업에 의한 생산량이 차지하는 비중이 높다. 특히 우리나라 주변 해역에서 행해지는 연근해어업의 생산물은 신선한 양질의 단백질을 공급받을 수 있어 수요가 높다. 어업에 의한 생산물을 경제적인 영향을 미치는데 생산물을 가공하는 가공업, 유통하는 유통업, 판매하는 서비스업뿐만 아니라, 직접 어업생산물을 구매하는 구매자에게도 영향을 미친다. 여러 산업에 걸쳐 중요한 기반이 되는 연근해어업은 현재 여러 문제점에 직면해있다.
첫째, 우리나라 해역에서 수산물을 생산하는 연근해어업은 1990년대 중반 전성기를 맞이한 후, 생산량이 계속해서 감소하는 추세를 보이고 있다. 수산자원은 재생산이 가능한 자원이기 때문에 자원량의 회복을 위하여 「수산자원관리법」을 근거로 총 허용 어획량을 설정하였고 자원량에 비해 많은 연근해어선의 척수를 줄이기 위하여 「연근해어업 구조개선 및 지원에 관한 법률」을 근거로 연근해어선 감척사업을 시행하였다. 하지만 총 허용 어획량 설정의 효과는 미비하였고 연근해 생산량은 계속해서 감소하고 있으며 감척사업 대상자에 대한 사후 지원이 부족하여 재진입이 계속되고 있다. 둘째, 우리나라 선박에서 발생하는 해양사고 중에서 어선이 차지하는 비율이 압도적이며 특히 연근해어선에서 발생하는 해양사고의 비율이 높다. 이에 「어선안전조업법」을 제정하고 해양사고 예방을 위하여 어업인 안전조업교육을 실시하고 있지만 연근해어선의 해양사고는 계속해서 증가하고 있다. 셋째, 연근해어업에 종사하는 어업인의 고령화가 계속되고 있으며 어가 인구 또한 계속해서 감소하고 있다. 이러한 인력문제를 해결하기 위하여 연근해어선에 외국인선원 승선제도를 도입하였고 외국인선원의 고용 및 관리 등을 위한 「외국인선원관리지침」을 시행하고 있다.
이 연구에서는 연근해어업의 현황을 통계자료를 통하여 살펴보고 이에 대한 연근해어업 관련 국내 법제를 검토 및 연근해어업 관련 외국의 법제 검토를 통하여 우리나라 연근해어업의 발전을 위한 개선방안을 법률적, 제도적으로 구분하여 제시하고자 한다. 법률적인 개선방안으로는 첫째, 노르웨이의 사례와 비교를 통하여 지역수산자원관리기구의 설립 및 그에 따른 「수산자원관리법」의 개정방안을 제시한다. 둘째, 미국과 EU에서 시행 중인 폐어구 관련 사례와의 비교를 통하여, 국회에 제출되었지만 제정되지 못한 「어구관리법」 제정안 분석을 통하여 폐어구에 의한 유령어업과 해양환경오염을 방지하기 위한 제정을 제안한다. 셋째, 일본에서 시행 중인 어선에서의 안전에 관한 법률과의 비교를 통하여 「어선안전조업법」의 개정방안을 제시한다. 넷째, 일본의 외국인선원 관리를 위한 법률을 통하여 「외국인선원관리지침」의 법률 제정을 제안한다. 제도적인 개선방안으로는 첫째, 감척사업 대상자에 대한 재정적인 지원 외에 이직 및 구직 등에 대한 지원 제도가 미비하여 감척대상자의 어업으로의 재진입이 많이 발생하고 있으며 이에 대한 개선방안을 캐나다의 사례와 비교하여 제시한다. 둘째, 지역수산관리기구의 설립이 힘들 경우, 인접국인 일본, 중국과의 공조를 통한 동북아시아 해역의 전반적인 수산자원관리에 대한 공조를 제안한다. 셋째, 현행 어업인 안전조업교육의 경우 지나치게 짧은 교육주기와 교육시간으로 구성되어 있어 교육의 효과를 기대하기 힘들고 교육의 인프라 부족에 따라 교육의 주기 및 재교육과정의 신설을 통하여 교육효과를 기대할 수 있도록 미국과 영국에서 시행 중인 안전교육과정과 비교를 통한 개선방안을 제시한다. 이러한 개선방안을 통하여 안전하고 생산성 좋은 연근해어업으로의 발전을 이루는 기반을 마련하고자 한다.
In Korea, food production by fishing has accounted for a large proportion of total food because of geographic influence. Products with high-quality protein from coastal and offshore fisheries around Korea are in high demand. Fishery products have an economic impact on the processing industry, distribution industry, sales service industry, and also buyers of fishery products. Coastal and offshore fisheries, the foundation of many industries, is now facing several challenges.
First, the production of coastal and offshore fisheries in Korea was highest in the mid-1990s and has been continuously decreasing since then. For the recovery of reproducible fishery resources, the 「FISHERY RESOURCES MANAGEMENT ACT」 has established a total allowable catch. And 「ACT ON THE RESTRUCTURING OF AND SUPPORT FOR COASTAL AND offshore FISHERIES」 established a project to reduce fishing vessels in the coastal waters. But setting a total allowable catch had little effect, and production of coastal and offshore fisheries continues to decline, and insufficient support for target fishers in projects to reduce the number of fishing vessels is causing the number of new fishing vessels to increase. Second, maritime accidents on fishing vessels account for the largest proportion of all maritime accidents in Korea. Although「FISHING VESSELS SAFETY FISHERIES ACT」 was enacted, and safety fishing education for fishermen is being conducted, coastal and offshore vessel accidents continue to increase. Third, the aging of the fishermen involved in coastal and offshore fisheries continues, and the population of the fishermen is also decreasing. In order to solve these problems, coastal and offshore vessels boarding system for foreign seafarers has been introduced, and 「FOREIGN SAILOR MANAGEMENT GUIDELINES」 is being implemented for the employment and management of foreign seafarers.
The purpose of this research is to suggest legal and systematic improvement methods for the development of Korean coastal and offshore fisheries by examining the Korean and foreign legal system related to coastal and offshore fisheries after studying the status and statistical data of coastal and offshore fisheries. As for the legal improvement method, first, it is suggested that regional fisheries resource management organization should be established and 「FISHERY RESOURCES MANAGEMENT ACT」 should be divised through comparison of cases of Norway. Second, the ghost fisheries and the marine environment pollution by abandoned fishing tools should be prevented through enactment of 「FISHING TOOLS MANAGEMENT ACT」, that was submitted to the National Assembly but was not enacted, by studying the cases related to abandoned fishing tools that are being implemented in the US and EU. Third, it is suggested that 「FISHING VESSELS SAFETY FISHERIES ACT」 should be revised through comparison with Japanese vessel safety related laws. Fourth, it is proposed that 「FOREIGN SAILOR MANAGEMENT GUIDELINES」 should be enacted through research on Japanese seafarers management act. As for institutional improvement method, first, the project to reduce the number of vessels provides financial support to the person concerned, but the support system such as job change and job search is not sufficient, which makes the people involved re-enter the fishery. So, this research suggests an improvement method for this through comparison with the case of Canada. Second, if it is difficult to establish a regional fisheries resource management organization, it is proposed to manage fisheries resources in Northeast Asian waters together with Japan and China. Third, the current fisheries safety education for fishermen is less effective because the training cycle and time are too short. So, this research suggests a method for improving the fisheries safety education through the establishment of education cycle and re-education course and through comparison with safety education implemented in the US and UK. With these improvement methods, this research aims to create a foundation that will make coastal and offshore fisheries safer and more productive.
