Abstract
Traditionally, ships have nationality and can not fly dual flags. The nationality of a ship represents the relationship between the ship and the country that granted it. Ship nationality is the standard for exercising national jurisdiction, and stateless vessels are not subject to a diplomatic protection of a state. The concept of this traditional ships nationality is dimmed because of the currency of flags of convenience.

The use of flags of convenience is traced back to the Roman times. There are records of Roman shipowners registered in Greece. In the 17th century English fishermen off Newfoundland adopted the French flag in order to avoid fishing restrictions imposed by Great Britain. British fishermen made similar use of the Norwegian flag in the 19th century. U.S. merchant vessels flew Portuguese flags during the War of 1812 to avoid difficulties with the British. Slave-trading ships owned by citizens of both the U.S. and various Latin American countries flagged elsewhere to avoid detection in the 19th century when international agreements prohibited the slave trade.

When U.S. shipowners moved to Panama in the 1950s to avoid the laws of their countries prohibiting the sale of alcohol, the flags of convenience, in the modern sense, have begun to use in full-scale. Using FOC has a few problems. So, international community has been trying to regulate the FOC, but lost its meaning due to the conflict between advanced maritime and developing countries. The system is internationally used as if it is legitimate.

FOC has several issues, but the most serious problem is the possibility of it can be used for international crimes. For examples, they can be used for drug and human trafficking and so on. From among these, a rising issue of international community is the proliferation of WMDs and related materials. The international community has been preventing the spread of WMDs through weapons export control treaties such as the Nuclear Non-Proliferation Treaty, the Biological Weapons Convention, the Chemical Weapons Convention and the Missile Technology Control Regime. However, these Treaties have limitation respect of international law that they cannot bind non-party states. And some articles of treaties caused conflict between interest groups or are invalid. Therefore, it was recognized that it is impossible to bind the non-state actors and states that smuggling WMDs.

DPRK uses this hole as an opportunity to develop a nuclear weapons and, in 1993, they leaves the Treaty on the Non-Proliferation of Nuclear Weapons. The international community including U.S. tried to talk with North Korea about returning to the treaty and halting nuclear tests. Notwithstanding many efforts, they conducted 6 times of nuclear test and uncountable ballistic missile launches. In response, the United Nations Security Council has been adopted resolutions about comprehensive sanctions against DPRK.

It was revealed that North Korea is trading WMDs and related materials through maritime transportation using ships based on the last So-san, the Ville de Virgo and the Chong Chon Gang case. They using FOC vessels. That is, in order to pressure North Korea effectively, it is necessary to impose sanctions on North Korean FOC vessels that they used for avoiding sanctions. The UNSC already recognized this fact and included in its resolution the cancellation of NK FOC ship registration and search of cargo and strengthened the sanctions against NK FOC vessels.

Lately, the UNSC adopted ‘UNSCR 2375’. In the process, the US submitted a draft that including forced search against NK FOC ships on the high seas. The draft was not accepted by Russia and China, ‘UNSCR 2375’ contains the search that was approved by the flag state. But the resolution says, if the flag State does not accept to inspection on the high seas, they shall direct the vessel to proceed to an appropriate an convenient port for the required inspection by the local authorities, and if a flag State neither consent to inspection nor directs the vessels to convenient port for the inspection, or if the vessel refuses to comply with flag State direction to permit inspection or proceed to such a port, then the Sanction Committee shall consider designating the vessel as a target of the sanctions and the flag state shall immediately deregister that vessel provided that such designation has been made by the Committee. As a result, that vessel becomes stateless ship and could be inspected on the high seas.

There is another principle to interdict NK FOC vessels on the high seas. After 9·11, the United State of America realized the importance of preventing proliferation of WMDs and established the Proliferation Security Initiative. Principles of PSI contain the interdiction of vessels on the high seas transporting WMDs, but this has problems that are against the principle of freedom of navigation and flag State jurisdiction. Thus, PSI endorsing States make efforts for justifying PSI through adopting UNSCR and amending Convention for the Suppression of Unlawful Acts against the Safety of Maritime Navigation and agreed bilateral ship boarding agreement with FOC states.

The NK FOC vessels openly navigate the Jeju-strait and even entered Po-hang and Ul-san port of the Republic of Korea. It means they could spy on ROK’s major facilities installed along the coastline including atomic power plants and naval bases. Their vessels could be used for a sudden attack on these facilities and deliver weapons to the inside agents and sustain huge damage to our territorial waters by self-destruct or something. So, it must not be accepted that the NK FOC vessels navigate through Jeju-strait.

In conclusion, the navigation of NK FOC ships through Jeju-strait must be stopped and it would be justified by ‘UNSCR 1540’, ‘UNSCR 2375’, ISPS Code and SUA Convention.|전통적으로 선박은 특정 국가의 국적을 가지며 이중국적을 가질 수 없다. 선박의 국적은 선박과 국적을 부여한 국가가 가지는 유대관계를 나타내는 것이다. 선박국적은 국가관할권 행사의 기준이며, 무국적선은 국가의 외교적인 보호를 받지 못한다. 그런데 선박과 국적을 부여한 국가의 유대관계에 대한 전통적인 개념은 현대에 와서 그 의미가 흐려지게 되는데 그것은 바로 편의치적 제도의 국제적 통용 때문이다.

편의치적은 활용된 때가 매우 오래된다. 로마시대 때 로마의 선박소유자는 그리스에, 세계대전 중에는 전쟁 당사국이 중립국에 치적한 사례들이 존재한다. 현대적 의미에서 편의치적이 본격적으로 활용된 때는 1950년대 미국의 선박소유자들이 주류의 판매를 금지하는 자국의 법률을 회피하기 위해 파나마로 이적하면서부터이다.

편의치적이 활발하게 이용되면서 여러 가지 문제점이 발생하였고, 이를 규제하기 위해 국제적 차원에서 다양한 시도를 하였다. 그러나 이러한 시도들은 선진해운국과 개발도상국의 갈등으로 무의미한 것이 되면서 편의치적제도는 합법적인 것으로 인식되고 통용되고 있다.

편의치적제도로 인한 문제 중 가장 심각한 것은 국제범죄에 활용될 소지가 매우 높다는 점이다. 예를 들면, 마약을 밀거래한다거나 인신매매 또는 밀항 등의 범죄에 사용될 가능성이 있다. 이중 국제사회의 주요 이슈로 대두된 것은 9·11 테러 이후 테러단체의 대량살상무기 입수가능성과 연계된 WMD 및 관련물자의 운송과 관련된 문제이다. 기존에 국제사회는 핵확산금지조약, 생물무기금지조약, 화학무기금지조약, 미사일수출통제체제 등의 무기수출 통제조약을 통해 대량살상무기의 확산을 방지하고 있었다. 그러나 이러한 핵확산금지조약과 생화학 무기의 수출을 통제하는 조약들은 비당사국을 구속하지 못한다는 국제법적 한계가 있었다. 또한, 조약 내용상 이익집단의 갈등을 초래하거나 실효성이 없었기 때문에 이를 통해 WMD를 밀거래하는 단체 및 국가를 구속한다는 것은 불가능한 것으로 인식되었다.

북한은 이와 같은 무기수출통제조약의 허점을 파악하여 1993년 핵확산금지조약을 탈퇴하고 독자적으로 핵 개발을 시도하였다. 미국을 포함한 국제사회는 북한이 조약에 복귀하고 핵실험을 중지하도록 만들기 위하여 수차례 대화를 시도하였다. 그러나 이러한 노력에도 북한은 여섯 번의 핵실험과 수차례의 탄도미사일 발사시험을 시행하였고, 유엔안전보장이사회는 그 대응으로 북한에 대한 포괄적인 제재조치를 수반하는 결의들을 채택했다.

지난 서산호 사건과 빌 드 비르고호 사건으로 북한이 선박을 이용한 해상운송을 통해 WMD 및 관련 물자를 밀거래하고 있다는 사실이 밝혀졌으며, 청천강호 사건과 지선호 사건 등으로 북한이 자금 획득을 위해 재래식 무기를 밀거래하고 있다는 사실이 알려졌다. 즉, 효과적으로 북한을 압박하기 위해서는 북한이 제재를 회피하기 위하여 사용하고 있는 선박에 대한 제재가 필요한 것이다. 유엔안보리도 이를 인식하여 결의 내용에 북한선박의 등록취소와 화물 검색의무에 대한 내용을 포함하고 있으며 북한선박에 대한 제재 강도를 점점 강화해왔다.

그러던 중 최근 채택된 유엔안보리 결의 제2375호의 채택 과정에서 미국이 공해상 WMD 운송 의심선박에 대한 강제검색을 규정한 초안을 제출하였는데, 중국과 러시아에 반대로 기국의 승인을 받은 검색을 규정하는 데 그쳤다. 그러나 결의 제2375호에서는 기국이 검색에 동의하지 않더라도 선박을 인근 항만에 입항시켜 항만국의 점검을 받아야 하고, 이를 모두 거부하거나 선박이 기국의 지시를 따르지 않는 경우 제재위원회는 동 선박을 제재대상으로 지정할 수 있다. 이 경우 기국은 즉시 그 선박의 등록을 취소하여야 하므로 결과적으로 당해 선박은 무국적선이 되기 때문에 검색할 수 있게 되었다.

한편, 지난 9·11 테러와 북한의 서산호 사건 이후 WMD 확산방지의 필요성을 인식한 미국은 PSI를 성립시켰고, 그 차단원칙에는 WMD를 적재한 선박에 대한 차단을 규정하고 있다. 그러나 이는 유엔해양법협약상 공해자유의 원칙과 기국주의 원칙에 위배되기 때문에 그 정당성을 확보하기 어렵다는 문제가 있다. 따라서 미국을 비롯한 PSI 참여국들은 PSI의 정당성을 확보하기 위하여 유엔안보리 결의의 채택, SUA 협약의 개정, 편의치적국과의 양자협정 체결 등의 노력을 하고 있다.

이렇게 국제적으로는 북한의 제재를 위하여 적극적으로 나서고 있는데, 우리나라는 다소 소극적인 태도를 보이고 있는 것이 아닌가 생각된다. 북한의 국적세탁 선박이 우리나라 영해인 제주해협을 버젓이 통항하고 있고, 이들 중 우리나라 항만에 주기적으로 입항한 선박이 존재한다. 이처럼 북한의 선박이 우리나라 영해를 통항하는 것을 묵인하는 것은 연안에 있는 주요 시설과 항만에 대한 염탐을 허용하는 것이며, 우리나라는 원자력 발전소와 해군 기지 등의 시설이 연안에 밀집되어 있기 때문에 국가안보의 큰 위협을 초래하는 것이다. 또한, 이들 선박이 주요 시설에 대한 기습의 가능성을 가지고 있고, WMD 및 관련 물자를 운송하고 있을 경우 우리 영해 내에서 좌초하거나, 침몰, 또는 자폭하여 막대한 피해를 줄 가능성을 가지고 있기 때문에 우리 영해 통항을 허용해서는 안 된다.

결론적으로 우리 영해와 배타적 경제수역을 통항하는 북한선박을 차단하는 조치가 필요하며, 이러한 차단의 정당성은 유엔안보리 결의 제2375호 등과 같은 북한선박 제재·차단 관련 결의들과 WMD 및 관련 물자 운송의 위법성을 규정한 결의 제1540호, WMD 운송을 범죄구성요건으로 규정한 SUA 협약, 불법무기적재선박에 대한 불이익 조치를 허용한 ISPS Code 등을 통해 확보할 수 있을 것으로 판단된다.
